Terms and Conditions of Ebike Mobile Repair

Welcome to Ebike Mobile Repair! By engaging our services, you agree to the following terms and conditions. Please read them carefully before proceeding with any repair or service.

Service Terms:

1. We utilize UL and other certified electrical parts, along with factory and aftermarket replacements needed, always offering options that meet your requirements.

2. Prior to initiating repairs, we will test your eBike through a 12-point mechanical systems inspection and 5-point electrically system inspection to evaluate your bike, providing you with a quote for approval.

3. For electrical issues, a diagnosis fee of $50.00 is required, which will be credited towards the repair cost. If electrical repairs are declined, the $50.00 electrical diagnosis fee is due before the bike is returned to the

customer.

4. All completed repairs, or electrical diagnosis must be paid and picked up within 30 days of completion.

5. Mechanical diagnosis is provided at no charge.

6. Should additional parts or labor be found necessary during the repair process, an updated quote will be presented accordingly for approval by the customer for the additional charges.

7. While rare, certain factors such as age, previous incorrect repairs, or unique product designs may result in incidental damage during repairs. Ebike Mobile will not be held liable for such occurrences.

8. Parts are covered solely by the manufacturer's warranty.

9. We offer a 30-day warranty against defects in workmanship only.

10. Pickup and delivery are independent of the warranty and are not included in covered repairs.

11. Exclusions from warranty coverage include: damage resulting from accidents, age, fatigue, tampering, not following the manufacturer’s care and use instructions or third-party repairs.

12. Standard shop rate is $100/hr for both electrical and mechanical repairs.

13. Stand pricing is posted for common services for your convenience.

14. Ebike Mobile reserves the right to refuse service to any individual for any reason.

Any dispute, controversy, or claim arising out of or relating to this agreement, including the formation, interpretation, breach, or termination thereof, including whether the claims asserted are arbitrable, will be referred to and final

determined by arbitration in accordance with the JAMS Comprehensive Arbitration Rules and Procedures.

1. Arbitration Rules and Administrator: The arbitration will be administered by JAMS, pursuant to its Comprehensive Arbitration Rules and Procedures.

2. Scope of Arbitration: The arbitration will resolve all disputes between the parties, including but not limited to disputes arising out of or related to the agreement, the services provided by Ebike Mobile LLC, and any interactions or transactions between the parties.

3. Location: The arbitration will take place in [City, State], unless the parties agree to a different location.

4. Arbitrator: The arbitration will be conducted by a single arbitrator. The arbitrator will be selected in accordance with the JAMS Comprehensive Arbitration Rules and Procedures.

5. Decision: The arbitrator’s decision will be final and binding on the parties. Judgment on the arbitration awa may be entered in any court having jurisdiction.

6. Fees and Costs: Each party will bear its own costs and expenses of the arbitration and will share equally the fees and costs of the arbitrator, unless the arbitrator determines that a different allocation is necessary in order to achieve an equitable result.

7. Confidentiality: The parties agree that the arbitration will be confidential, and that the existence of arbitration, any documents exchanged or produced during the arbitration, and any rulings or awards will not be disclosed to any third party, except as may be necessary to effectuate the arbitration award or as required by law.

8. Severability: If any provision of this arbitration clause is found to be unenforceable, that provision will be severed and the remainder of this arbitration clause will remain in full force and effect.

Ebike Mobile LLC - Repair Service Liability Waiver

I, ____________________________, hereby acknowledge that I am requesting repair services for my electric bicycle ("Ebike") from Ebike Mobile LLC ("the Business"). In consideration of receiving such repair services, I voluntarily agree to release, indemnify, and hold harmless the Business, its owners, employees, agents, and representatives from any and all liability, claims, demands, actions, or causes of action arising out of or related to the repair services provided by the Business, including but not limited to:

1. Any risks in ebike operation that may result in property damage or personal

injury.

2. Any defects or malfunctions in the ebike following the repair services, including

those that may result in personal injury or property damage.

3. Damaged or defective electrical parts that may cause fire or result in proper

damage or bodily injury due to failure.

Ebikes are often manufactured in countries where safety and quality standards may not meet US expectations. This can lead to significant or even catastrophic losses in t

event of failure. Such risks associated with Ebike operation, maintenance, and storage are the sole responsibility of the owner. Ebike Mobile assumes no liability for any losses resulting from Ebike ownership or operation.

I acknowledge the inherent risks associated with operating an Ebike, including the risk of personal injury or property damage, and understand that the Business cannot

guarantee the safety or performance of the Ebike following the repair services.

I confirm that I have had the opportunity to inspect the Ebike and discuss any concer

or questions I may have with the Business before the repair services commence.

I certify that I am the legal owner of the Ebike or have the authority to consent to the

repair services on behalf of the owner, and that I am at least 18 years of age.

I acknowledge that I have read and understood this Liability Waiver in its entirety, and I voluntarily agree to its terms.
